So, yes, it is illegal to have a private server. And its illegal to take payment (even if its volunteer) for something that you don't own.

If you live in Russia you can take other peoples material, like games and music, and use it however you like, because they don't have a copyright law and therefor no punishment for that kinds of actions. And they don't have any delivery agreement with other countries, so if you live in Russia and make a private Maple server Nexon can not take you to court.
- But that's pretty much it, if you live anywhere else you might get a fine that putts your wallet on fire or a maximum of 50 years in jail. In most countries you only get the fine, but in some states in the US you can get the 50years and some places in Africa and in Kina they might kill you, or just chop off your hands or tongue.

The problem with most private servers is that they are driven by minors, so it would give Nexon more profit to sue the company that give them space to have their illegal game on than suing a 14year old. Pressing charges against 14year old kids is illegal in most countries anyway, but that only means that their parents would have to pay for it, instead of the child going to jail.

Its just not legal to take someone else creation and use it for yourself, not even if you do not edit it or do not take charge for it.
Its not even legal to take random pictures of the internet, its just as illegal as stealing an artists painting. And mostly gives you a couple years in prison, unless the artist do not wish to press charges.

But its always a slim chance of being sued or punished for having a private server, but I do know that Nexon have hacked some private servers, and the servers have died pretty fast.

I would be pissed if anyone stole my creations, but what I do do not cost anything for others to use. Well, usually. Some of my creations do cost, but I would definitively press charges against anyone who stole my creations.
